Online Purchase Terms and Conditions
These Online Purchase Terms and Conditions apply to any product you buy through the Genier's Appliances website. By placing an online order, you confirm that you have read, understood, and agreed to these Terms and Conditions. If you do not agree with them, you may not place an order on our website.

These Terms are in addition to the Genier's Appliances Website Terms of Use, which govern general use of our website.

 

1. Acceptance of These Terms
These Terms and Conditions form a legally binding agreement between you and Genier's Appliances Ltd., a company registered under the laws of the Province of British Columbia, Canada. They apply to any order placed through our website (the “Website”). By submitting an order, you unconditionally accept the current version of these Terms. If you disagree with any of the terms, you should not place an order. In the event of a conflict between these terms and any other policy or agreement related to your purchase, these Terms will prevail.

 

2. Orders
Products displayed on our Website are an invitation to make a purchase, not a direct offer. When you submit an order using the provided website features, you are making an offer to buy the items listed. After submitting your order:
(a) you’ll receive an automated email confirming receipt of your order; and
(b) a Genier's Appliances representative will follow up to confirm the order details, including any shipping or delivery information.
Once we confirm the details, we will issue you an invoice—this will serve as our formal acceptance of your order. Additional verification or information may be required before your order is finalized.

 

3. Order Restrictions
You must be of legal age in your province of residence and able to enter into a binding agreement in order to place an order. Genier's Appliances reserves the right to:
(a) limit product quantities per individual, household, or order; and
(b) refuse or cancel orders suspected to be made by resellers or dealers.

4. Customer Accounts
You may be given the option to create an account to make the ordering process more convenient. If you choose to do so, you are responsible for all actions taken through your account, including maintaining the confidentiality of your login credentials. You agree that all account information you provide is accurate and complete. Genier's Appliances may suspend or deactivate your account at any time, with or without notice.

 

5. Pricing and Additional Fees
Prices shown on the Website are in Canadian dollars and exclude taxes, delivery fees, environmental handling charges, and applicable MARR (Major Appliance Recycling Roundtable) program fees. Prices are guaranteed for up to nine (9) months from the date your order is placed. If your delivery occurs beyond this period, the price may change based on updated manufacturer costs.

An estimate of applicable taxes and environmental fees will be provided at the time of purchase. If these amounts increase before your order is delivered or picked up, you will be responsible for paying the difference at that time. Genier's Appliances also reserves the right to adjust prices to reflect any government tariffs in effect at the time of delivery.

Additional fees may apply for deliveries outside standard service areas, for oversized or heavy items, or for additional in-home services (such as moving old appliances to another location within the home).

 

6. Payment
By placing an online order, you agree to pay the full amount, including the product cost, taxes, delivery, and environmental fees. Your payment method will be authorized and charged at the time your order is submitted. If extra charges apply (such as updated environmental fees), you authorize Genier's Appliances to charge the difference at the time of delivery or pickup.

 

7. Promotions, Discounts, and Price Matching
We may occasionally offer promotional pricing or discounts. These prices are effective as of 12:00 AM PST on the date advertised, and may include additional terms and conditions.

Genier's Appliances offers a price match guarantee in accordance with our Price Match Policy, which is considered part of these Terms and Conditions.

 

8. Shipping, Delivery, and In-Store Pickup
Shipping and delivery services, as well as in-store pickup options from Genier's Appliances locations or warehouses, are provided in accordance with our Shipping, Delivery, and Pickup Policy, which is incorporated into these Terms and Conditions.

9. Cancelling Orders

Genier's Appliances reserves the right to cancel any order, in whole or in part, at any time prior to shipping. This may occur for reasons including, but not limited to:
(a) the item ordered is out of stock or no longer available;
(b) quantity restrictions apply per customer, household, or order;
(c) pricing or product information was inaccurate or contained an error;
(d) the product has been subject to a manufacturer’s recall;
(e) fraud or suspected fraudulent activity associated with your order;
(f) your order contains incomplete or incorrect information; or
(g) the order violates these Terms or applicable legal requirements.

If we cancel your order, we will notify you by email.

If you wish to cancel your order, please contact us using the details provided in your order confirmation email. Genier's Appliances may accept or decline a cancellation request at its discretion, except where cancellation rights are guaranteed under British Columbia consumer protection laws. Please note that cancellations may be subject to a restocking fee.

 

10. Return Policy

Product returns are subject to the Genier's Appliances Return Policy, which is hereby incorporated into these Terms and Conditions by reference.

 

11. Refurbished, Open-Box, and “As-Is” Products

From time to time, Genier's Appliances may offer discounted products through its Website, including:
(a) Refurbished items – previously returned products that have been repaired and tested to function like new;
(b) Open-box items – new, unused products that may be missing original packaging or have had packaging opened or replaced; and
(c) “As-Is” products – items that may have cosmetic imperfections such as dents or scratches but are guaranteed to operate as intended.

Each product offered at a discount will be clearly marked on the Website, along with the reason for the reduced price.

Some of these items may still be covered by the manufacturer’s warranty. In certain cases, Genier's Appliances may offer a limited-time warranty for an extra fee.

Unless covered by a warranty, all discounted products are sold as-is, as available, with all faults, and are final sale. These products must either be picked up in-store or be scheduled for delivery within seven (7) days of receiving your invoice.

 

12. Currency, Errors, and Product Availability

The information and content presented on our Website is updated regularly but may not always reflect real-time accuracy or completeness. Despite our efforts, occasional errors, outdated information, or omissions (including in pricing, descriptions, and availability) may occur.

Genier's Appliances does not guarantee that all items shown online are in stock or available for immediate purchase. Online prices may also differ from in-store prices. We make no representations or warranties regarding the accuracy of Website content, including images, pricing, or specifications.

We reserve the right to:
(a) correct any mistake, inaccuracy, or omission without prior notice;
(b) update or remove product listings, pricing, promotional offers, or other content at any time;
(c) refuse or cancel any order placed, online or otherwise; and
(d) restrict product quantities sold or made available to any individual or household.

13. Your Information

You agree that all personal, contact, and payment details you provide at the time of ordering—such as your full name, address, email, order number, and credit card information—are true, complete, and accurate. Genier's Appliances will rely on this information to process your transaction. You are responsible for updating your details if they change, and for any costs or issues that arise from false or outdated information.

By submitting your information, you consent to its collection, use, storage, and disclosure by or on behalf of Genier's Appliances in accordance with our Privacy Policy and as permitted by law. We may rely on any communication or information provided by you, unless we have reason to doubt your identity or authority. We also reserve the right to verify your identity and decline to act on any request we cannot authenticate to our satisfaction.

 

14. Limited Genier's Appliances Warranty

Genier's Appliances warrants that any product purchased through our Website will carry the brand or trade name identified at the time of purchase. You acknowledge that your purchase is based on that trade name. Except as expressly provided in this section, and to the fullest extent permitted by law, Genier's Appliances disclaims all other warranties, whether express, implied, statutory, or arising from trade practices. This includes, but is not limited to, warranties of merchantability, fitness for a particular purpose, durability, availability, performance, or suitability.

 

15. Manufacturer and Extended Warranties

Some items may be covered by warranties issued by the product manufacturer. You acknowledge that:
(a) the manufacturer, not Genier's Appliances, provides the warranty;
(b) Genier's Appliances is not liable for the content or performance of that warranty;
(c) you had the opportunity to review the terms of the warranty at the time of purchase; and
(d) the manufacturer's responsibility is typically limited to repair or replacement during the stated warranty period.

Extended warranties may also be available for purchase through third-party providers. If you buy one, you accept that the extended warranty is offered by a third party and not by Genier's Appliances, and that we assume no responsibility for its coverage.

Any such warranties (manufacturer or extended) are subject to separate terms and do not form part of these Online Purchase Terms and Conditions.

16. Limitation of Liability

Under no circumstances will Genier's Appliances be liable to you or any other party for any damages or losses—whether direct, indirect, incidental, consequential, special, punitive, exemplary, or loss of use—arising from or connected to:
(a) your use of the Website;
(b) any content on the Website, including product details or pricing;
(c) any online order, including unauthorized access to or changes to submitted order information; or
(d) any product purchased through the Website, including its use, condition, or availability.

You agree to follow all product use and maintenance instructions as provided by the manufacturer. Genier's Appliances is not responsible for damage, malfunction, or failure caused by accidents, misuse, modifications, improper installation, or lack of maintenance.

 

17. Updates to These Terms

Genier's Appliances may revise these Online Purchase Terms and Conditions at any time, without prior notice, by updating the version posted on the Website. Any changes become effective immediately upon posting unless otherwise stated. It is your responsibility to review the latest version, which will be identified by the "Last Updated" date. By placing an order after changes have been made, you agree to be bound by the revised Terms. You may not alter these Terms under any circumstance.

 

18. Governing Law

These Terms and all related matters will be governed solely by the laws of the Province of British Columbia, and the federal laws of Canada applicable therein, excluding conflict of laws rules that may apply the laws of another jurisdiction. This applies unless otherwise required by local consumer protection laws.

 

19. Dispute Resolution

Unless otherwise required by law, any disagreement or claim arising from or relating to these Terms or any transaction conducted through the Website (a “Dispute”) will be settled through final and binding arbitration administered by ICDR Canada under its Canadian Arbitration Rules.

• The arbitration will be conducted by a single arbitrator.
• The location of the arbitration will be Vancouver, British Columbia, and the language will be English.

Despite the above, Genier's Appliances reserves the right to pursue urgent legal remedies—such as injunctive relief—through the courts of any relevant jurisdiction to protect its legal rights or enforce these Terms.

Unless otherwise required by law, if you do not begin legal action within twelve (12) months of the Dispute arising, your claim will be permanently barred. Any statutory limitation periods shorter than twelve months remain unaffected.

 

20. General Provisions

Binding Effect: These Terms are binding upon you and your legal representatives, including heirs, executors, administrators, and permitted assigns. They are also for the benefit of Genier's Appliances and its successors and assigns.

No Waiver: A failure or delay by Genier's Appliances to enforce any term or right will not be considered a waiver. A waiver must be in writing and signed by an authorized representative.

Cumulative Rights: The rights and remedies provided herein are cumulative and may be exercised in addition to other legal or equitable remedies available to Genier's Appliances.

Assignment: You may not transfer or assign these Terms without prior written approval from Genier's Appliances. We may assign our rights or obligations under these Terms without notice or consent.

Severability: If any part of these Terms is found to be invalid or unenforceable, that portion will be severed, and the remainder will continue in full force, unless the invalidity undermines the essential purpose of the agreement.

Interpretation:

• References to “these Terms” refer to the entire agreement.
• Headings are for convenience only.
• Words in the singular include the plural and vice versa.
• “Including” means “including without limitation.”
• “Law” refers to both statutory and common law.
• “Person” includes both individuals and legal entities.

Entire Agreement: These Terms represent the full agreement between you and Genier's Appliances concerning your online purchase and replace all prior agreements or discussions on the same subject matter.

Language: You and Genier's Appliances have requested that these Terms, as well as all related documents, be written in English.
